Gravity Nelson Limited: Outline of liability and responsibility
You must agree to the following terms and conditions before undertaking any mountain biking activity (Activity) with Gravity Nelson Limited (Gravity).
Risks: By its nature, mountain biking activities involve inherent risks, dangers and hazards.
⃞ I acknowledge that the variety of surfaces including trails, roads, and man-made and natural trail features may further increase these risks.
⃞ I understand that there is a level of skill, health and experience required in undertaking mountain biking activities safely.
Safety: In order to manage the risks involved, I agree to:
⃞ Follow the instructions of all Gravity staff at all times.
⃞ Wear appropriate safety equipment for the duration of any Activity. I understand that it is mandatory to wear a helmet and gloves at all times, and that knee pads, elbow pads and a full-face helmet are strongly recommended.
⃞ Inspect my bike or have it checked by a qualified bike mechanic before commencing any Activity.
⃞ Inform Gravity staff of any pre-existing medical conditions or health issues prior to commencing any Activity. I agree to make and take responsibility for my own decision to participate in any Activity with Gravity.
⃞ Remain in control and within my ability level. I understand that I must be able to avoid other people or objects at all times.
Equipment:
⃞ I acknowledge that I am financially responsible for any damage to equipment borrowed or rented from Gravity, including any damage to vehicles or other assets caused by me.
Insurance:
⃞ I understand that I am solely responsible for any medical, health or personal injury costs relating to my participation in any Activity with Gravity.
⃞ In the event that coverage is not approved under the Accident Compensation Act 2001, I acknowledge that I have been advised to check the coverage of my medical insurance.
Photographs: Gravity respects your privacy and complies with the Privacy Act 1993. Any images posted online will be removed by request.
⃞ I understand that photographs and videos may be taken of participants at any time for marketing, advertising or other purposes.
Agreement:
⃞ I agree to undertake this activity at my own risk & assume all risk of personal injury, property loss or damage.
⃞ I agree to waive any and all claims that I have or may in the future have against Gravity and any associated person, including, but not limited to, its directors and employees.
⃞ I agree to release Gravity from any liability for any loss, damage, expense or injury that I may suffer resulting from any involvement in, or travel to or from, in an Activity with Gravity.
⃞ I agree to indemnify Gravity from any and all liability for any damage to property of, or personal injury to, any third party resulting from my involvement in, or travel to or from, any Activity with Gravity.
I acknowledge that I have read and understood this waiver of liability and indemnity, and I am aware that by completing the online waiver I am agreeing to these terms and conditions.
